TERMS AND CONDITIONS
FIRST CLAUSE – Participants:
1.1 Tour Operator TRIBUTREEK Cia. Ltda. Company, legally represented by Mr. Luis Tonato, from now and for the purpose of this contract “AGENCY” is called.
1.2 The person who hires the services of the Agency from now on will be called “The Tourist”.
1.3 The third party operating the tour hereafter “the operator” will be called.
SECOND CLAUSE – Purpose of the agreement:
TOURIST hires the agency to provide the service of advice and contacts with tour operators and travel required to participate in the activities of the destinations chosen by tourists.
THIRD CLAUSE – Obligations of the parties:
2.1 Provide all necessary information that tourists require their contract or tour destination trip.
2.2 Always have the willingness to help the tourist in everything you need.
2.3 Contact the family, the insurance company or embassy of the tourist in case of accident caused by an act of providence or force majeure. The Agency is not liable for injury, death or any other damage caused in carrying out the activities arranged by the tourist.
3.1 Having understood and accepted social risks moving inside Ecuador involved and the risks involved in the practice of extreme sports, mountain biking, rafting, tubing, rock climbing, mountain sports, trekking, camping, rappelling, canopy , horseback riding, snorkeling, scuba diving and any activity or sport where contact with nature. Tourists also clearly understand the risks of injury associated with force majeure or acts of providence, such as wars, internal unrest, protests, strikes, terrorism, fires, natural disasters, decisions of public authorities, or other extreme circumstances, and you agree that the agency will not be responsible for loss, injury or damage to persons or property by any of the above causes.
3.2 Having valid life insurance and trip covering all risks to the date of completion of the contracted tour or in the absence of any type of insurance and it does not intend to get one frees AGENCY liability for any type of accident, death, injury or physical problem that occurs during the contracted trip.
3.3 Having all immigration documents a day in order to comply with Ecuadorian law and inform the Agency of any special requirements be it the power, disability or illness that exists in the course of the trip.
3.4 Be in good health and physical condition to participate in the trip is booked.
FOURTH CLAUSE – Deposit and confirmation of the tour
4.1 Your booking is confirmed by the Agency only after receipt of a payment of 40% deposit must be received within 60 days prior to the tour start date, depending on the type of trip the Agency will require the tank to 90 days prior to travel.
FIFTH CLAUSE – Payment
5.1 The total balance of the trip fee must be paid no later than 30 days before departure otherwise the Agency may treat the booking as being canceled by the tourist.
5.2 The Agency reserves the right to change the price of a tour without notice in case of any unforeseen price increase by a third party.
SIXTH CLAUSE – Cancellation Information
6.1 Cancellation by the customer must be made in writing and will only be effective once the agency receives the letter or mail cancellation.
6.2 If the TOURIST cancellation is received 91 days or more before travel, the initial value of 40% deposit will be refunded less a charge of $ 250.00 for administrative service and the cancellation costs to third parties.
6.3 If the TOURIST cancellation between 61 and 90 days prior to departure, depending on the tourist travel contract could lose 100% of the value of the initial 40% deposit for service is received.
6.4 If the TOURIST cancellation less than 60 days prior to departure, depending on the tourist travel contract could lose 100% of the total value of the trip is received.
SEVENTH CLAUSE – Information Alteration
7.1 The Agency reserves the right to cancel or modify the tour itinerary due to force majeure or acts of providence, such as wars, internal unrest, protests, strikes, terrorism, fires, natural disasters, decisions of public authorities, or other extreme circumstance, any action will always be taken by safeguard the safety of tourists this may include replacement, guide, hotel, transportation, meals, tourist destinations.
EIGHTH CLAUSE – Transportation from the meeting point
8.1 The tourist is committed to present to the meeting in good time to the time of departure
Ninth Clause – Grievance Procedure and refunds
9.1 If the tourist experiences a problem during the trip, then you must inform the agency immediately via mail or in writing, and in this way the agency to intervene or request information from the other party to have a consistent and positive solution.
9.2 The Agency will act as an intermediary in negotiating rebates with the operator on behalf of the tourist. In any case the Agency gives guarantee of a satisfactory response or reimbursement by the operator.
9.3 The agency shall not be liable to refund any of the following situations:
– Itinerary changes before or after departure.
– Mechanical problems affecting all modes of transport on the trip.
– Replacement of facilities or personnel.
– Late arrival or presentation of the tourist.
– The decision of the tourist to leave the tour early or activities miss food, lodging during the tour.
– The tourist traveling without the required documentation, including passports, visas, immigration papers or certificates of vaccination.
– The differences in prices paid by different passengers on the same tour including special rates last minute.
– The decisions of third parties that affect the normal operation of the tour that includes the operator, the government of Ecuador or the authorities of protected areas
– Any other circumstance on tour arising beyond the control of the Agency.
CLAUSE – Information
10.1 All information provided by the Agency in good faith and based on the latest information available at the date of publication.
ELEVENTH CLAUSE – Acceptance and contract duration
11.1 The contract exists if the agency receives either deposit or full payment from the TOURIST until the end of the trip that has been hired. The payment to the Agency by the tourist either the deposit or full payment means that tourists agree with all the terms of this contract.
11.2 Anything not directly stipulated in this contract shall be governed by the law of Tourism of Ecuador
TWELFTH CLAUSE Jurisdiction & Process
12.1 In case of dispute the parties submit to the civil judges of Quito and the Code of Civil Procedure governing in Ecuador.
